The court found that the disclosure order encompassed assets beneficially held through associated companies and bank accounts in Hong Kong; the plaintiff adduced sufficient evidence (company records, bank statements and circumstantial inferences) to satisfy the evidential burden and, in the absence of credible responses from the defendant, the court drew irresistible inferences of beneficial ownership and deliberate non‑disclosure; contempt was therefore proven beyond reasonable doubt and breach of undertaking by the plaintiff is not a defence to non‑compliance with a court order.
