The Tribunal held that as at the resumption date the lots lacked vehicular access and were subject to a Block Government Lease covenant prohibiting erection of buildings without approval; s12(c) LRO therefore excludes any value based on expectancy of obtaining building licences or lease modification; accordingly the best use was open storage with pedestrian access only and compensation was assessed on that basis using comparable sales, giving total compensation of HKD 163,181.
