The court excluded Mr Wong's opinion evidence on the likelihood of competition because he was an employee and the sole source of expert opinion on a critical issue, he had not been adequately advised or shown an appreciation of the full duties of an expert (including disclosure of reliance on work of others), and admitting that undisclosed, central opinion would risk unfair determination of the appeal; accordingly exclusion was required in the interests of a just and fair hearing.
