Section 50(6) of the Public Order Ordinance, properly construed, authorises a police officer to search the digital contents of a mobile phone seized on arrest without a warrant only in exigent circumstances; that limitation makes the provision compatible with BOR s14 and Basic Law Art 30; the construction argument that digital content is situated in a separate place from the device is rejected.
