The Ordinance does not apply retrospectively to offences committed before its commencement; section 25 prevents the Costs in Criminal Cases Ordinance from covering criminal proceedings arising from offences committed prior to 17 January 1997, so costs awarded under the Ordinance for such offences cannot stand.
