The judge found on credibility and documentary evidence that an agreement was reached at the 24/12/1998 meeting to complete the remainder of the voyage on the plaintiff's Fixture and that the 1st defendant had dealt with the plaintiff as charterer; the 2nd defendant was an undisclosed principal, giving the plaintiff an election against the agent; however, the court's final holding states that the charterparty particularised in the claim was a contract between the plaintiff and the 3rd defendant (as set out in paragraph 2 of the Statement of Claim).
