The judge accepted Mr Tung's credible unshaken oral evidence that an Oral Agreement replaced the Written Agreement entitling him to HK$150 million and an additional HK$50 million; found he performed his obligations; held the payments made were part payments/acknowledgements so under s.23(3) Limitation Ordinance the limitation period ran from the last payment in October 2008 and the writ issued in 2013 was in time; Mr Wei failed to adduce evidence to rebut those findings; accordingly judgment is entered for Mr Tung and costs for the contested video link application are awarded on an indemnity…
