Although pleadings were inadequate and a retrial might have been appropriate, on the evidence accepted by the trial judge and not challenged by the appellant it was established that respondents paid at least the contract price; therefore the appellant proved no loss and the appeal against the claim failed, but the court accepted respondents' concession for the purposes of the appeal and substituted judgment on the counterclaim in respondents' favor for the overpayment of $1,684.39; no costs order was made.
