The Court certified a single point of law of great and general importance: whether conspiracy to commit misconduct in public office is made out where conspirators agreed that, in return for a payment to a person known to be about to become a public officer, the recipient would be and remain favourably disposed to the payer while in office; the Court declined to certify other points and held that allegations as to provenance/third‑party reimbursement are not essential elements of the s.4(1) bribery offence charged in Count 7.
