The appellate court concluded the trial judge had misappreciated and under-weighted material evidence (notably the sub-tenant's corroboration of handcuffing and the unreliable, muddled testimony of CHAN Kuen) and had expressed findings in a way that, taken with other deficiencies, left a lurking doubt as to the safety of the convictions; accordingly the convictions were unsafe and were quashed.
