The taxing master exercised discretion to uphold the majority of counsel fee items: concluded senior and junior counsel were necessary and proper given the monetary value, complexity, novelty of legal and factual issues (including section 76 defence and grey market issues), the need to handle expert evidence and crucial witness credibility; most challenged items were reasonable or had been appropriately reduced at taxation, except item 344 which was further reduced to HK$6,000 on review; costs of the review were ordered against the losing party consistent with these findings.
