The Court concluded the Foundation was justified in seeking a second opinion on important and difficult points affecting administration of the estate; the appeal provided guidance beneficial to the estate. Accordingly, as an exception to the general rule, the costs of the Foundation, the Secretary and the 1st Defendant were ordered to be borne by the estate and to be taxed on a trustee basis; certificates for counsel were granted.
