The Tribunal held that the word 'land' in section 12 of the Sewage Tunnels (Statutory Easements) Ordinance is unqualified and includes any piece of land whether or not that land was identified in Gazette notices under sections 4 or 6; restricting 'land' to gazetted parcels would produce inconsistency with section 12(2) and frustrate the remedial purpose of section 17A of the Building Ordinance, which can affect building works on non-gazetted land and give rise to compensable loss.
