The court held that the contribution was a one‑off payment for Building Authority ordered works and not a special fund item under paragraph 4(2) Seventh Schedule BMO; therefore the EGM resolution based on undivided shares could not override the DMC and the contribution must be apportioned in accordance with clauses (d) and (e) of the Third Schedule to the registered Deed of Mutual Covenant.
