The District Court has concurrent jurisdiction because the plaintiffs' rights and remedies arise not solely from the BMO but also from the DMC and common law; there are serious questions to be tried about the validity of the Resolution and procedural conduct of the owners' meeting; on balance of convenience the status quo must be preserved to prevent a fait accompli, therefore an interim injunction restraining the IO from taking steps to appoint a new manager until the Adjourned Hearing is granted; costs to follow as ordered.
