Even if section 20A(2) applied and was not complied with, the statutory scheme (as amended) renders such a contract at most voidable and SKLAC retained authority until the IO avoids the contract; there was insufficient basis to stay, strike out, set aside the notice or make SKLAC personally liable for costs and the amended summons must be dismissed with costs to the IO.
