The Tribunal held that Clause 13(A) of the DMC and the Third Column of the Fourth Schedule expressly fix the monthly contributions for the management costs referred to in Clause 13(A); therefore those contributions must be apportioned according to the Management Shares in the Fourth Schedule rather than by undivided Ownership Shares under BMO s22, and the Manager's discretion to revise amounts does not permit changing the contribution proportions among owners.
