On the objective construction of the DMC against the factual matrix at the time of execution the 3rd Schedule must be read adopting the physical 2&1 layout for the ground and 1st floors; Clause 7(b) is wide enough to include major renovation costs; consequently the 2009 and 2011 general‑meeting resolutions adopting the 29&24 basis and purporting to recover fees on that basis are null and void and the defendant's counterclaim is dismissed.
