On the facts, with contemporaneous documents and witness testimony considered, the trial judge correctly found ECA did not breach the standard of skill and care: acting on Circular Letter 58 and the prevailing governmental practice was reasonable; the defendants' approach to exemptions (claiming those necessary for the approved design and seeking further entitlements as required) was an acceptable professional practice; no deliberate concealment of the Appeal Tribunal decision was found; therefore no liability and appeal dismissed.
