Applicant failed to prove breaches of the DMC: no evidence of nuisance, expert evidence established no adverse effect on structural integrity, no evidence that utility supply to other parts was affected, and the works did not require Building Department approval such as to render them illegal; accordingly injunctions were refused and costs awarded to Respondents.
