The judge erred in holding there was no serious question to be tried; whether the 2001 alterations breached clause 9(c) of the DMC, and whether other owners acquiesced to the long use of the gate are factual matters for trial (especially because the owners' corporation was incorporated only in 2010), and the interlocutory injunction should be granted after refusing to admit the late additional evidence proposed by both sides.
