The court held that the applicants, having cut back the adjacent Crown slope and installed drainage, created a construction amounting to 'support' under the Crown Lease and were therefore liable to comply with the S.27A notice and to bear appropriate costs; however the Building Authority's certificate of apportionment was quashed insofar as it failed to consider a fairer apportionment of contractor-specific works and benefits to 14-16 Mount Parker Road, and the matter was remitted to the Authority for reconsideration and re-issuance of a certificate.
