Although the judge's direction permitting an adverse inference from the appellant's silence was wrong, the evidence of custody and control of the suitcases and the implausibility of the appellant's explanation were so strong that the error could not have had a substantial effect on the jury's verdict; therefore the proviso applies and the conviction is upheld.
