The conviction was quashed because the Crown failed to adducesufficient evidence that the appellant was 'habitually in the company' of a prostitute so as to engage the statutory presumption under s137(2); the magistrate misapplied the burden of proof by relying on the defendant's evidence and should have dismissed the case at the close of the prosecution case; consequently the conviction could not stand.
