The court held the judge's starting point of 21 months was too low; an appropriate starting point including aggravation was 30 months, a one-third guilty plea discount reduced that to 20 months, and a further allowance of three months for late restitution yielded an appropriate sentence in the region of 17 months; notwithstanding this, the court dismissed the application for leave to appeal against sentence and declined to increase the sentence under section 83I.
