Leave to appeal was refused because it was not reasonably arguable that s.32(a) of the MTR By‑laws fails the proportionality test; s.32(a) is a narrow, legitimate restriction on one mode of expression directed to controlling advertising and protecting the Corporation's property and users, and the applicant's freedom of expression was adequately balanced against those interests.
