On a full re‑hearing of the evidence including CCTV and dashcam footage the appellant’s account was not credible, the prosecution evidence proved the appellant reversed without seeing the motorcycle, and the court was satisfied beyond reasonable doubt that the appellant was guilty of careless driving; appeal dismissed.

Objective CCTV and dashcam evidence, read with witness testimony, established that when the appellant turned and continued to drive in a crowded car park he failed to observe a vehicle emerging from a parking bay and did not exercise reasonable care and attention; minor inconsistencies in witness timings and police sketches did not render the conviction unsafe, so the appeal is dismissed.

The magistrate erred by rejecting the appellant's evidence about premature airbag deployment and by imputing dishonesty from rejection of other aspects of the account; because an airbag may inflate without good reason and the expert could not rule out premature deployment, the appellant was entitled to the benefit of the doubt and the evidence was insufficient to sustain a conviction for careless driving.
