Application dismissed because prosecution failed to show sufficient justification to displace milestone trial dates so close to trial given (1) lack of available suitable court facilities in the proposed period, (2) undue prejudice and disproportionate inconvenience to defendants and their counsel from late consolidation and likely need for reassignment, (3) material public health risks from COVID-19 that could disrupt a mass trial, and (4) absence of a material change in circumstances outweighing the Practice Direction 9.3 protection for trial dates.
