The court refused to alter its earlier judgment: on the facts the third defendant was not to be held to have submitted to the jurisdiction because the filings were consistent with an intention to challenge jurisdiction, the drafting error was understandable given misleading practice notes, and Order 18 r 2(3) supported not penalising the defendant; accordingly the appeal was allowed on that ground and the post-judgment application to receive further submissions was dismissed.
