On the balance of probabilities the deceased's fall was caused by a bamboo pole that gave way due to defective fastenings; the defendant, as occupier and main contractor, failed to take reasonable steps to ensure the scaffolding was safe, failed properly to supervise inspection and the scaffolding contractor, and thereby breached duties including under the Occupiers' Liability Ordinance. There was no contributory negligence by the deceased, and plaintiff entitled to damages subject to set-off for Workmen's Compensation.
