On the totality of indicia the applicant was an employee of the respondent at the time of the accident; monthly earnings are calculated at $1,050 x 23.15 = $24,307.50 under s.11 but capped by the Sixth Schedule maximum of $23,580; applying the agreed 50% permanent loss of earning capacity and the certified period of incapacity, the court awarded statutory compensation of $848,880 (s.9), $140,011.20 (s.10) and $5,240 (s.10A), less $170,000 already paid, giving judgment for $824,131.20 with interest and costs.
