The Court held that under the amended s67C the judge must determine minimum terms for prescribed prisoners sentenced to discretionary life terms; in doing so the judge must evaluate the gravity of the offences with a view to retribution and deterrence, may consider relevant post‑sentence materials but must ignore prior executive determinations, and accordingly fixed minimum terms for the four respondents as follows: Lam Hung 25 years; So Ching Kwan 12 years; Ho Tung Shing 20 years; Fung Wai Hon 22 years.
