Applicants failed to establish a viable triable issue that they together were entitled to terminate any trust and call for the capital; the transfers, if a trust arose, were for a specific purpose (wedding expenses) and not an outright gift, so they have no counterclaim exceeding the debts supporting the statutory demands; accordingly the statutory demands were properly not set aside and the appeals are dismissed.
