The Court held that on the accepted evidence the Medical Council was entitled to find that the Appellant was associated with a beauty centre that engaged in advertising/canvassing, that the fee arrangement and conduct supported an inference of indirect canvassing and improper sharing in fees, and that those findings constituted misconduct in a professional respect; the Warning Notice is advisory, not exhaustive, and did not prevent the Council finding misconduct on the facts; accordingly the appeal was dismissed.
