The applicant demonstrated sufficient locus and evidence to show the Estate may have an interest in the Lots and there exists a bona fide question to be tried between the plaintiff and the applicant; under Order 15 r 6(2)(b) the court must allow joinder to enable effectual adjudication and therefore the joinder application is granted and the plaintiff's application for default judgment must be dismissed pending resolution of the joined issues.
