The magistrate's careful credibility finding was not plainly wrong; accepted evidence established the vehicle struck the pedestrian and objectively the appellant's driving fell far below that of a competent and careful driver under s37(4) and (7); therefore the elements of dangerous driving were proved beyond reasonable doubt and conviction was properly upheld.
