The court held that a time charterer who signs bills of lading containing a demise clause manifests an intention not to assume personal liability and therefore incurs no personal liability which the Hague Rules could be said to void; accordingly Clause 17 validly operated to exclude the charterer’s personal liability and the judge’s decision for the 2nd defendants was correct.
