Liability for the collision was admitted; the court accepted documentary and expert evidence (notably joint neurology, psychiatry and ophthalmology reports) and found the plaintiff a malingerer due to numerous material inconsistencies between his accounts and the contemporaneous records and observed non-physiological findings.
