The court found the Crown could not prove beyond reasonable doubt that statements of the 3rd and 4th accused were voluntary given the preceding informal discussion, refusal to permit consultation with a solicitor, prolonged custody conditions (handcuffing, fatigue, lack of food/drink) and resultant unfairness; accordingly those formal cautioned statements were excluded.
