Sections 3(1) and 3(2) of the OLR authorise issuance of a preliminary Certificate of Apparent Eligibility based on appearance; they do not oblige the Law Society to make a final determination of eligibility for admission at that stage, and issuance of the preliminary certificate did not create a legitimate expectation that passing the Examination would automatically entitle the applicant to a Certificate of Eligibility; accordingly the Law Society lawfully refused the Certificate of Eligibility and the judicial review fails.
