The evidence, though gravely suspicious, did not exclude the reasonable possibility that the 2nd appellant acted through gross negligence and dereliction of duty rather than pursuant to an agreement with the 1st appellant; accordingly the circumstantial evidence was insufficient to prove the required agreement beyond reasonable doubt and the convictions could not be sustained.
