The wife failed to prove on the balance of probabilities that the husband transferred the painting in May 2011 with the intention, at least in part, of defeating her claim for ancillary relief. The painting is properly characterised as inherited family property acquired from a source external to the marriage and the 2005/2011 arrangements were found to be family preservation and intra‑family financial arrangements rather than fraudulent dispositions to defeat marital claims. Accordingly the transfer was not set aside and the wife’s relevant summons paragraphs were dismissed.
