Where parties have entered a contract of sale with the defendants as purchasers on the face of the contract, the vendor may recover the price notwithstanding side arrangements between the purchasers and a third party; a payment-by-letter-of-credit stipulation inserted for the vendor's protection may be waived by the vendor; and a cheque being an unconditional order cannot be made conditional by parol evidence, so the alleged oral condition to withhold presentation was inadmissible.
