Because the plaintiff failed to obtain a judgment better than the first sanctioned payment and it was not unjust to apply O 22 r 23 having regard to the expert evidence and the parties' conduct, the court ordered that the defendant pay the plaintiff's costs up to and including 16 July 2014 on the High Court scale, the plaintiff pay the defendant's costs from 17 July 2014 onward to be taxed on the High Court scale and on an indemnity basis, and that the plaintiff pay interest on those costs from 17 July 2014 at 2% above the judgment rate, with moneys retained in court pending taxation.
