The Court accepted the documentary evidence as credible and admissible under s.83V(2), held medical age estimation was inconclusive and unnecessary, and ruled that the Court of Appeal may itself determine under s.70 whether it appears the offender was under 18; on that basis the Court found the appellant was under 18 at the time of the offence and set aside the death sentence and commuted sentence, substituting detention until Her Majesty's pleasure.
