On the admitted facts and documentary record the court found that Hau and successors unequivocally denied TFK’s title and treated the whole lot as their own, the 1974 Action was abandoned (by latest 1986) so limitation restarted, and by 2006 the plaintiff and predecessors had adversely possessed the defendant’s half share for at least 20 years; consequently the plaintiff acquired an indefeasible possessory title and the defendant’s title was extinguished under section 17 Limitation Ordinance; counterclaim for rents dismissed.
