Because the Plaintiffs failed to disclose material circumstances in their ex parte application, the 1st-7th Defendants were released from their undertakings and the Plaintiffs were ordered to pay the costs of the ex parte hearing, the June continuation hearing and the 1st-7th Defendants' summons on an indemnity basis to be taxed and paid forthwith; indemnity costs were appropriate given the unjustified use of ex parte procedure and the severable nature of those costs; costs allocation for the 8th Defendant and later hearings followed from who properly defended or was affected by the summonses.
