On the facts the court concluded there is no real risk of the Government taking enforcement action by re-entry: historical Government conduct, long uninterrupted dealings and conveyancing transactions involving third parties, sporadic correspondence without enforcement and the severe consequence of forfeiture make enforcement unlikely; therefore the vendor has shown and proven good title under section 12 CPO.
