There is a real conflict of interest between D2 and the deceased's estate because D2 is sued in his personal capacity and benefits under contested later wills and powers; Kookie had been lawfully appointed committee and that appointment was affirmed by the Court of Appeal; pending resolution of the validity of the wills and powers, Kookie is the appropriate person to represent the estate for the purpose of this action and the Master's order appointing him is upheld.
