Leave to appeal against sentence was granted because there was an arguable issue as to whether the correct starting point for sentence should have been the lower starting point appropriate to theft in a common area, notwithstanding that the building was residential; however the court held the judge was entitled to enhance sentence for safety risk and prior convictions and that the level of enhancement was within the available range.
